Introduction

Access to the PharmD_KS Trading Doggy Style (“services”, “the course”, “course”, “discord”, “discord membership” or “discord access”) Is provided at the sole discretion of PharmD_KS (“Provider” or “PharmD_KS”). Your access and utilization of these services is conditional on your acceptance and compliance with these Terms. By accessing and using this website, you agree to be bound to these Terms, and you further acknowledge that a breach of these Terms may result in permanent suspension of access to any of the subscribed services. You agree that you will not access or utilize these services if you do not agree to be bound by these Terms

Overview

PharmD_KS provides educational information to third parties to assist them in better understanding financial markets for educational purposes only. The terms contained herein apply to all services. Analysis and insights about the financial markets or other musings may be provided at the Provider’s sole discretion for educational purposes only. PharmD_KS makes no guarantee as to the timing, quantity, or quality of information provided as the course and discord membership are for educational purposes only and do not provide financial advice.

Intellectual Property Rights

The intellectual property rights (“IPR”) associated with the course, including without limitation trademarks, patents, copyrights, trade secrets, proprietary strategies, User Submissions (defined below) and contents of the course (including any pictures, writing, archives, information materials, strategies and product designs), are the exclusive proprietary rights of Provider. In no event shall you modify, copy, broadcast and transmit in public, recompose, disseminate, distribute, publish, reverse engineer, decompile or disassemble any content in the course without Provider’s prior authorization. Failure to comply will result in legal action as per “Venue” below and immediate removal from the course. If you intend to cite or reprint the above-mentioned procedures or product contents, you must obtain prior written consent of Provider, which may be withheld in Provider’s sole discretion. You understand that IPRs are critical to the success of Provider, and if the provisions of this section are violated, you agree to be liable to Provider or the appropriate affiliate for compensatory damages, including court costs and attorneys’ fees.

User Submissions

Provider may permit the submission of content by certain users, or all users, including, for example, comments, articles, analysis, links, and conversations in the course (“User Submissions”). By posting any such User Submissions, you agree to grant Provider an irrevocable, perpetual, worldwide, non-exclusive, royalty-free license (with all rights to sublicense) to use, copy, reproduce, store, publish adapt, process, modify, display, transmit, and distribute such User Submission content (in any manger available, now know or later developed). Provider also has the right, without notice, and in its sole discretion, to comment on, monitor, censor, edit, move, and/or remove any and all content posted in the course at any time and for any reason. There is no guarantee or representations regarding the completeness, truthfulness, accuracy, usefulness or reliability of any content or User Submission in the course. The content in the course does not necessarily endorse opinions of Provider. Provider may not monitor or control all content or User Submissions in the course.

Use

Provider, at their sole discretion, grants you a temporary and revocable limited license to access the course. By using this course, you agree to: (i) not engage in actions that obstruct other users’ experience; (ii) refrain from sharing or distributing inappropriate content; (iii) use the course and any information thereon strictly for lawful purposes only; (iv) not attempt to manipulate or extract data; (v) not claim or imply that any statement has the endorsement of Provider; (vi) not sublicense, translate, sell, reverse engineer, or disassemble any part of the course; (vii) not frame or mirror any content, use automated tools to manipulate course content (viii) not collect other user, visitor, or Provider information without consent, send unsolicited advertisements or infringe on intellectual property rights, threaten or disrespect other users or Provider, incite hatred, use profanity, publish or transmit illegal or unlawful content, transmit pornography (regardless of how tasteful it may be) publish another user’s personally identifiable information, impersonate others, engage in illegal activities, distribute spam or harmful code, post or take any action or encourage any conduct which would give rise to civil liability or otherwise violate any law, or solicit or advertise inappropriately in the course.

Course access is provided at the sole discretion of Provider on an “as is” “where is” and “as available” basis. Provider make no representations or warranties of any kind, express or implied, regarding any of the information, educational materials, content, products, included herein. Provider is not an investment, financial, tax, or legal advisor or a broker-dealer and does not purport to provide personalized investment, financial, tax, or legal advice in any form. Provider is strictly providing educational information, does not recommend the purchase of any particular securities, nor does the Provider make any promise or guarantee regarding any particular investment result. Because neither Provider does not have any control over such sites and resources, you acknowledge and agree that Provider is not responsible for the accuracy, availability or content of such external sites or resources. Provider does not endorse and is not responsible for any content, advertising, products, or other materials on or available through such sites or resources, and you agree that your access to or use of such websites, content or services is entirely at your own risk. You further acknowledge and agree that Provider is not responsible, directly or indirectly, for any damage or loss caused, or alleged to be caused by or in connection with use of or reliance on, any such content, goods or services available on or through any such other site or resource.

Refund Policy

By purchasing the course, discord membership or any other service provided by PharmD_KS, you acknowledge and agree there are no refunds for any reason.

Limitation of Liability

Provider shall not be liable for any direct, indirect, incidental, consequential, special, exemplary, punitive, or any other damages, whether arising from contract, negligence, strict liability, or any alternative legal theory, in connection with, or related to, the course, its information and content, or any product or service obtained or procured through the Provider or in the course. The Provider’s total liability under these Terms and for providing and operating the course shall not exceed $0. By accessing and utilizing the course, you agree to accept sole responsibility and liability for any damages you may incur and you also agree not to hold PharmD_KS liable under any and all circumstances.

Changes to Terms

Provider reserves the right to modify these Terms at any time with or without prior notice for any reason. Your continued use of the course following any such modifications constitutes your agreement to be bound by any modified Terms.

Termination

Provider, in its sole discretion, may at any time terminate or suspend all or a portion of the any of the offered services, or your use of all or a portion of said services, with or without notice and with or without cause.

Account

In order to access the course or content in the discord membership, you may have to create an account. By creating this account you agree to: (i) provide complete and accurate information; (ii) maintain only a single account; (iii) keep confidential your user name and password; (iv) not provide or authorize access to your account to any third party; (v) maintain responsibility for all content reviewed and posted by your account; (vi) notify Provider of any unauthorized use of your account; and (vii) not circumvent any measures Provider has put in place to protect the privacy or confidentiality of your account or information, or the account or information of ourselves, or other users.

Venue

Any legal action, arbitration, or proceeding arising under or in connection with the breach of these terms shall be brought exclusively in the state courts of Arizona or federal courts of The United States of America or the Supreme Court of the United States of America. Users hereby consent to the personal jurisdiction of such courts. Users further agree that the state laws of Arizona and/or the federal laws of the United States of America shall govern the resolution of any disputes arising from or related to this contract.

Agreement

These Terms constitute the entire agreement between you and Provider regarding the use of the course or discord access. Your violation of the Terms may result in permanent removal, or other losses of privileges from the course or discord membership, in Provider’s sole discretion.
